Killerspin collects most of this personal information directly from you via our Site. Killerspin collects information when you:

  • Register/create an account with Killerspin;
  • Interact with the Killerspin Site and use Killerspin Services;
  • Communicate directly with us through the Site;
  • Visit Killerspin Site pages or the pages of certain Killerspin partners through cookies on our website (in accordance with your consent preferences); or
  • When you enter promotions or related offerings on our Site.

Killerspin may combine information about you that we have with information we obtain from business partners or other companies.

3. Why We Use Personal Data

We collect and/or share your personal information for the following business purposes:

  • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards;
  • Helping to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate for these purposes;
  • Performing services on behalf of the business, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business or service provider;
  • Providing advertising and marketing services;
  • To comply with our legal and regulatory obligations;
  • For our legitimate interests or those of a third party; or
  • Where you have otherwise given consent.

A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests. We may share aggregated or anonymized information with third parties without restriction.

4. Who We Share Your Personal Information With

In the preceding 12 months, we have sold or shared consumers' personal information with:

  • Service providers we use to help deliver our Services to you, such as payment service providers, warehouses, and delivery companies;
  • Other third parties we use to help us run our business, such as marketing agencies or website hosts;
  • Third parties approved by you, including third party sites you choose to link your account to or third-party payment providers; and
  • External auditors.

We only allow our service providers to handle your personal information if we are satisfied that they take appropriate measures to protect your personal information. We also impose contractual obligations to ensure personal information is used only to provide services to us and to you.

We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.

We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or during a re-structuring. We will typically anonymize information, but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.

5. Children

Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 18. If we learn we have collected or received personal data from a child under 18 years old without verification of parental consent, we will delete that information.

Killerspin will not contact children under age 13 about special offers or for marketing purposes without a parent's permission. Killerspin does not ask a child under age 13 for more personal information, as a condition of participation, than is reasonably necessary to participate in a given activity or promotion.

6. Information Sharing and Disclosure

Killerspin does not rent or sell personal information. Subject to your legal rights, Killerspin does not share personal information about you with other people or nonaffiliated companies except to provide Services you've requested, when we have your permission, or under the following circumstances:

  • We provide the information to trusted partners who work on behalf of or with Killerspin under confidentiality agreements.   • Killerspin displays targeted advertisements based on personal information. Advertisers (including ad serving companies) may assume that people who interact with, view, or click on targeted ads meet the targeting criteria — for example, women ages 18–24 from a particular geographic area. 9. Cookies

Killerspin and our partners use various tools to collect information when you use our Services (including making purchases of our products), visit our Site, including cookies, pixels, advertising identifiers and other similar technologies. 11. How Long Your Information Will Be Kept

We retain personal data only for as long as there is ongoing business need to do so, such as providing Killerspin Services, complying with legal, tax, or accounting requirements, or for security and fraud prevention.

The specific criteria we use to determine our retention periods includes:

  • Relationship Duration: Data is kept for the length of time we have an ongoing relationship with you (e.g., as long as an account is active or services are being used).
  • User Action: Whether you choose to modify or delete your information through your account.
  • Legal Obligations: Whether Killerspin has a legal obligation to keep the data (for example, certain laws require Killerspin to keep records of your transactions for a certain period of time).
  • Legal Protection: Whether retention is advisable based on our legal position, such as applicable statutes of limitations, litigation, or regulatory investigations.

Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

16. Changes to This Policy
